These Terms govern your use of the Form Builder at kdevelopment.nl (the “Service”). By creating an account
or using the Service, you agree to these Terms.
1) Service description
The Service lets you create and share forms, collect responses, and optionally enable add-ons such as
submission viewing and email notifications (“features”).
2) Accounts
- You must provide accurate information (including a valid email address) and keep it up to date.
- You are responsible for your account credentials and all activity under your account.
- We may suspend or terminate accounts that violate these Terms.
3) Your content & responsibilities
- You own the forms and submission data collected through your forms.
- You are solely responsible for complying with applicable laws (e.g., GDPR) and for providing a privacy notice to your respondents.
- Do not collect special category data without a lawful basis and appropriate safeguards.
- Do not use the Service for unlawful content or activities, spam, malware, or harassment.
4) Processor terms (data processing)
For respondent data collected via your forms, you are the controller and we are your processor. We process that data
only on your instructions (i.e., as configured in your forms) to provide the Service, implement security, and fulfill legal obligations.

5) Features, trials, and limits
- Features (e.g., “View submissions”, “Email notifications”) are activated via packs/slots with durations.
- Free combo trial: one 3-day trial per IP (and per user if IP is unavailable). We store the IP (binary) only to prevent abuse.
- We may apply fair-use and rate-limits to protect the platform.
6) Payments & refunds
- Payments are processed by PayPal. We receive transaction status/IDs; PayPal handles your payment instrument.
- Prices and discounts are shown before purchase. Some discounts may not apply to 1-month or single-slot purchases.
- If a payment succeeds but slots are not credited due to a technical issue, contact info@kdevelopment.nl with your PayPal transaction ID.
- Refunds are assessed case-by-case where required by law or in cases of duplicate/accidental purchases.
7) Availability & changes
We aim for high availability but do not guarantee uninterrupted Service. We may modify the Service, features, or pricing.
Material changes will be communicated in a reasonable manner.
8) Prohibited conduct
- Reverse engineering, scraping, or abusing rate-limits.
- Uploading malware or interfering with the Service.
- Collecting data unlawfully or in violation of privacy rights.
9) Intellectual property
The Service, its software, and branding are owned by us or our licensors. You retain ownership of your forms and submissions.
10) Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, lost profits,
or data loss. Our total liability for any claim relating to the Service will not exceed the amounts paid by you in the 12 months
preceding the claim.
11) Indemnity
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your forms, or your breach of these Terms.
12) Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or for security/abuse reasons.
13) Governing law
These Terms are governed by the laws of the Netherlands. Courts of the Netherlands will have exclusive jurisdiction, without prejudice to mandatory consumer protections where applicable.
